Povzetek
Prispevek obravnava pravne standarde varstva pred diskriminacijo v izobraževanju, s poudarkom na Sloveniji in sodbah Evropskega sodišča za človekove pravice (ESČP). Slovenska ustava in zakonodaja zagotavljata varstvo pred diskriminacijo, zlasti za ranljive skupine, kot so romski otroci, verske manjšine in osebe z invalidnostmi. Avtorica opozarja na skrite oblike diskriminacije, kot je morebitna prikrita segregacija romskih otrok, in poudarja pomen spremljanja prakse. Analizirane sodbe ESČP se nanašajo na segregacijo romskih otrok, pravice oseb z invalidnostmi ter vprašanja verske svobode v šolah. Sodišče v teh primerih poudarja pomen enakosti, vključevanja in razumevanja posebnih okoliščin. Prispevek ugotavlja, da so evropski pravni standardi pomemben smerokaz za slovenski vzgojno-izobraževalni sistem, ki se mora stalno prilagajati za preprečevanje diskriminacije in spodbujanje vključevanja vseh otrok.
Abstract
European Legal Standards of Protection against Discrimination in
Education and Their Relevance for Slovenia
This his paper discusses legal standards of protection against discrimination in education, with a particular focus on Slovenia and the case law of the European Court of Human Rights (ECtHR). The Slovenian Constitution and legislation ensure protection against discrimination, especially for vulnerable groups such as Roma children, religious minorities, and persons with disabilities. The author draws attention to hidden forms of discrimination, including the potential covert segregation of Roma children, and emphasises the importance of monitoring practical implementation. The analysed ECtHR judgments address the segregation of Roma children, the rights of persons with disabilities, and issues of religious freedom in schools. In these cases, the Court highlights the importance of equality, inclusion, and the consideration of specific circumstances. The paper concludes that European legal standards serve as an important point of reference for the Slovenian education system, which must continually adapt to prevent discrimination and promote the inclusion of all children.
